· 801 and 803 Sycolin Road: The Board of Supervisors shall consider dedicating 1,044 square feet (0.0240 acre) in fee simple for public street right-of-way, and granting 15,405 square feet of temporary construction easement, to the Town of Leesburg, Virginia, through and across a portion of certain County-owned properties located at 801 and 803 Sycolin Road, Leesburg,

AMENDMENTS TO CHAPTER 612 OF

THE CODIFIED ORDINANCES OF LOUDOUN COUNTY

DOGS AND OTHER ANIMALS

Pursuant to Virginia Code §§ 15.2-1427 and 3.2-6543, the Board of Supervisors gives notice of its intention to propose for passage amendments to Section 612.02, Definitions; 612.03, License Tax; 612.13, Running at Large; 612.17 Disposal of dead companion animals; 612.19 Other Unlawful acts; 612.23, Seizure and disposal of abandoned, neglected, cruelly treated animals; and 612.26(b) Kennel License Fee of the Codified Ordinances of Loudoun County in order to bring the regulations of Chapter 612 into conformance with the current requirements of the Code of Virginia, and to clarify existing requirements. The proposed amendments would have an effective date of October 1, 2017, and include, without limitation, the following:

Proposed Amendments to Section 612.02, Definitions:

Ø Revise the existing definitions for “Animal Control Officer” or “Deputy Animal Control Officer”, “Home-based rescue”, and “Releasing Agency”.

Ø Delete the existing definition for “Dog running at large”.

Ø Establish new definitions for “Leash” and “Kennel”.

Proposed Amendments to Section 612.03, License Tax:

Ø Clarify existing regulations in regard to the licensing period for dogs, payment of the license tax, and issuance of the tag that demonstrates that a dog is licensed.

Ø Establish a new kennel license and tax applicable to owners of five (5) or more dogs kept in a kennel for certain purposes, in lieu of individual dog licenses and taxes. The kennel licensing period will run from January 1 to December 31 of each year, the license tax must be paid no later than January 31 of each year, and proof of a current rabies vaccine for each dog in the kennel must be provided before a kennel license is issued.

Ø Establish a new exemption from license taxes for dogs currently working with law enforcement agencies.

Proposed Amendments to Section 612.13, Running at Large:

Ø Replace existing prohibition on dogs running at large with a new prohibition that focuses on dogs that are off the property of its owner or custodian without being on a leash.

Ø Establish new exemptions that permit certain dogs to be off leash, to include, without limitation, dogs enclosed in certain dog parks or dog exercise areas, dogs used while lawfully hunting, dogs engaged in certain training classes, dogs used as service animals by certain individuals or for certain purposes, and dogs located within certain low density areas of the County.

Proposed Amendments to Section 612.17, Disposal of Dead Companion Animals:

Ø Revise existing regulations to require the owner of any animal or fowl, and not just a companion animal, that has died to cremate or bury the animal’s or fowl’s body or request that the County perform these services.

Ø Establish a new process by which the Court may order the County to cremate or bury a dead animal or fowl if the owner fails to do so.

Ø Revise existing regulations in regard to the County’s recovery of costs from owners for dead animals or fowl cremated or buried by the County.

Ø Establish a new regulation that any person violating this Section shall be guilty of a Class 4 misdemeanor.

Ø Establish a new exemption to this Section for animals or fowl used for food or in any commercial manner.

Proposed Amendments to Section 612.19, Other Unlawful Acts:

Ø Revise existing regulations to apply to all animal noise, and not just dog noise.

Ø Revise the existing standard for violations of this Section to include any animal noise that continues for ten minutes or more that is audible and discernable in any other person’s residential dwelling with the doors and windows to that other person’s residential dwelling closed.

Ø Delete existing regulations in regard to companion animal odor.

Proposed Amendments to Section 612.23, Seizure and Disposal of Abandoned, Neglected, Cruelly Treated Animals:

Ø Revise existing regulations to increase the amount of the bond that may be posted, for purposes of postponing the disposition of an animal that the County has seized due to abandonment, neglect or cruel treatment, to cover up to nine (9) months of reasonable expenses in caring for the animal.

Ø Clarify existing regulations in regard to such bonds being forfeited by the owner if the Court determines that an animal has been abandoned, cruelly treated, or deprived of adequate care, and that such bonds not being forfeited if the owner is found to be not guilty of the violation.

Ø Establish the methods that the Court may order for the County’s disposition of animals that the Court has determined to be abandoned, cruelly treated, or deprived of adequate care.

Ø Establishes that the owner of an animal that has been determined by a court to have been abandoned, cruelly treated or deprived of adequate care shall not be permitted to purchase, adopt or otherwise obtain the animal.

Proposed Amendments to Section 612.26(b), Fee Schedule, Kennel License Fee:

Ø Revise the existing Kennel License Fee (tax) to increase such fee to $40.00 for every 20 dogs covered under the Kennel License.

WestDulles Station, LLC, of Dulles, Virginia has submitted applications for the following: 1) To replace the concept development plan and the proffers approved with ZMAP-2005-0021, West Dulles Station, with a new concept development plan and proffers in order to permit the

development of the subject property under the current PD-IP (Planned Development–Industrial Park) zoning district regulations at a maximum Floor Area Ratio (FAR) from 0.4 to 0.6 (up to 1.0 by Special Exception); 2) To rezone approximately 28.42 acres from the PD-IP (Planned Development–Industrial Park) zoning district under the Revised 1993 Zoning Ordinance to the PD-IP (Planned Development–Industrial Park) zoning district under the Revised 1993 Zoning Ordinance in order to permit the development of all principal and accessory uses permitted in the PD-IP zoning district under the Revised 1993 Zoning Ordinance at a maximum Floor Area Ratio (FAR) of 0.60 (up to 1.0 by Special Exception); and 3) A Special Exception to permit an increase in the maximum FAR of the PD-IP zoning district from 0.6 to 1.0. These applications are subject to the Revised 1993 Zoning Ordinance and the proposed increase in FAR is permitted by Special Exception under Section 4-506. The subject property is located within the Route 28 Taxing District, and within the AI (Airport Impact) Overlay District, within the Ldn 65 or higher and between the Ldn 60-65, aircraft noise contours. The subject property is approximately 28.42 acres in size and is located on the east side of Lockridge Road (Route 789), south of Prentice Drive (Route 1071), and west of Randolph Drive (Route 1072), at 22426 Lockridge Road, Sterling, Virginia, in the Broad Run Election District. The subject property is more particularly described as Tax Map Number /94//17/////A/ (PIN: 063-49-6156). The area is governed by the policies of the Revised General Plan (Suburban Policy Area (Sterling Community) and Route 28 Corridor Plan) which designate this area for Route 28 Business uses at a recommended a FAR of 0.4 to 1.0 or Transit Related Employment Center (TREC) uses at a recommended a FAR of 0.6 to 2.0.
