Animal Control: Owner, not deputies, responsible for dog’s death

A Herndon man whose dog succumbed to the heat inside of a parked car will now face criminal charges.

Stuart Grimes, 24, was arrested June 21 and charged with animal cruelty and confinement of an animal in a vehicle.

The charges stem from an incident that occurred the morning of May 31. Deputies responded to the IHOP at Cedar Lake Plaza in Sterling after receiving a report of an intoxicated person at the restaurant.

Grimes was taken into custody after a brief struggle. He was later taken before a magistrate judge and charged with drunk in public and obstruction of justice.

During this time, Grimes’ dog “Rex” was in the Chrysler sport utility vehicle in the parking lot of the restaurant. Rex was a 4-year-old Labrador-Boxer mix. The dog remained in the car, and Rex died from symptoms related to heat stroke.

Grimes has claimed that he told the arresting deputies and the personnel at the adult detention facility that the dog was in the car.

If this had been the case, then those personnel could potentially be charged with those same charges Grimes’ currently faces.

The Loudoun County Sheriff’s Office and Department of Animal Control conducted parallel investigations into the incident.

According to a statement by Loudoun County shelter administrator Laura Rizer, there was no evidence to support or confirm Grimes’ allegations that the deputies were notified that the dog was in the car.

While the Sheriff’s Office investigation is ongoing, spokesman Kraig Troxell told the Times-Mirror that the evidence so far matches that of the Animal Services investigation.

According to Troxell, no evidence has been found to indicate that Grimes mentioned the dog – or even the vehicle – to either the deputies who made the arrest or the personnel at the adult detention facility.

Both animal cruelty and confinement of an animal in a vehicle are Class 1 misdemeanors under Virginia law and each carries a maximum penalty of 12 months in jail and a $2,500 fine.

@Susan….I hope you never leave a dog, child, elderly person in your car for a few minutes and have a heartattack for stroke outside your car.  Are you saying that because he was drunk it was OK not to check his car?  You are the stupid moron.  If he had not been drunk and had got into a fight?  If he had a stroke?  What police officers don’t check someone car in a crime or accident?  You make no sense.

My bad, I assumed Mr. Grimes realized his dog was left in the car before he left IHOP and plead for help at that time.
I guess it wasn’t until after he was processed and placed in jail did he remember.  Thanks for clearing that up.


Payback, sorry to break it to you but the examiner.com you are using to back up your claim is not even a reliable source. At the bottom it says the author works for a dog rescue. She is not a journalist and not a very impartial reporter if you ask me. It doesn’t even appear that they ever talked to either party involved, but rather just pulled stuff from the internet and facebook.

I will forgive your ignorance.  Not everyone has common sense and intelligence. Some have neither and I forgive those.  Anyway… the vehicle was not occupied, the subject was in custody and posed no reasonable threat while detained, searching the vehicle was not justified.  Once arrested they did not have to search the vehicle.  If he would have parked a mile a way, would htey have searched it? NO. If he walked there after leaving the dog in the car at home, they would not drive there either. He screwed up. The deputies followed protocol.  You and Mr. Grimes will not find an attorney that will follow through with a lawsuit.  You have nothing. Actually YOU are nothing, Mr. grimes is the person that can waste his time trying, YOU can only sit on the sidelines (on this forum) doing nothing but whining on his behalf.  I guess everyone has to have something in life to look forward to.

You seem to be close to the source.  So when Mr. Grimes was calling for Rex in the parking lot, where was Rex?  Most dogs I know get excited when called by their owner.  With the constant calls for Rex by Mr. Grimes, I would have expected the dog to be become very excited, maybe even bark, or jump up and down, or paw at the window of the car.

@ YouIdiot….perfect name for you.  Sounds rather cop like to me.  Who said it was ok to drive drunk and leave your dog in the car????  He was arrested for that Idiot.  It is not ok for the cops to arrest someone with a car and then not check the car for other people, drugs, is the car stolen?  You would think the cops would want to know these things.  I have spoken to Stu many times and his story is always the same.  The cops keep changing their story everytime a video tape or a witness comes forward.  I did them, to Stu’s attorney.  How do you know he had 3 phone calls?  I assume you were there, that figures.  Loudoun’s finest.

If the cops have a dead person sitting in iHops and search the body and find a driver’s licenses, do they look around for the car or just take the dead body away and leave the car there for the resturant to wonder about?


@Billye Thompson:  This article in no way indicates that Grimes is being “tried, convicted, and hung”.  It does say that Grimes claimed he told deputies & personnel at the jail about the dog in the car and “if this had been the case, then those personnel COULD potentially be charged”.  COULD means they can still potentially have charges placed against them but as of now there is enough evidence only to arrest Grimes.  @Angela Valianos - according to your telephone conversation with me at your request: your “high-powered” pro bono attorneys for Grimes had evidence proving Grimes was telling the truth.  If this is so then you shouldn’t have to worry about “disappearing evidence from the police locker”.  As far as your Facebook dramas are concerned you have done some supporters of Rex and any changes to be made with regard to how he died a great dis-service by excluding them from being involved; if that is your true agenda.  Personally, when you asked me to call you & you began interrogating me, because that’s what it amounted to, I became a little edgy about your motives.  When you asked me to get you information involving the police department, because I am friends with an officers wife and friends with someone in the court system, I became even more skeptical as to why your “high-powered” attorneys couldn’t get their own information.  You and your Facebook posse are turning this into a circus.  I suggest you follow your own advice, “wait for the FACTS to come out BEFORE you blame Mr. Grimes” and I also say before you blame the police department.  As you write, I’m sure there will be other lawsuits with regard to this.  As for the information you imparted to me about the police (in uniform) visiting and “intimidating” one of Mr Grimes’ close friends who you say they put in the hospital because of their visit I, so far, have found nothing valid to support this.

You again, confirm that leaving a dog in a vehicle with the windows rolled up while he loiters “drunk” in public? You also swear, that you have proof that he told someone? WHO? Names them.  Also… during his 3 phone calls while incarcerated, who did he call?  Can you please explain why he did not call 911 or someone to warn them of his dog and his ignored pleas. No doubt Grimes is an idiot. However, since audio and video exists of much of the incident, is it asking too much to have a disinterested third-party review the tapes?  based on my limited experience with the LoCo Sheriff’s Office, I dont think this is as farfetched as some might think.  If the LoCo Sheriifs think its perfectly OK to hold some 16 year olds at a house party with a can of beer in their hand at gunpoint, who knows what they might do? Let’s review the tapes and find out.

Bottom line it should never have depended on the police or any third party to protect the welfare of the dog.  Just like when you have a child with you, you do not get so drunk that you can’t take care of the animal.  If he were in his own home of course the dog would be fine but he was out partying with the dog in tow.  He could have wrecked his car or even passed out in it himself.  If you want to get so drunk that you can’t make it home you should not have a helpless animal with you. He was obviously too drunk to consider what would happen if he left the dog in the car to begin with.  Please don’t tell me he didn’t know it would get hot or he didn’t realize he was dangerously close to passing out. That is why he stopped at the IHOP to begin with.  Since he didn’t have enough respect for the dog to leave him at home when he went drinking, he should have called someone to come get the dog before he went in the nice air conditioning to succumb to his drunken stupor.


Fourth Amend & Reasonable are right.  The allegation that a single deputy/IHOP employee/IHOP customer heard Grimes’ pleas and was so cold-hearted that he/she was willing to let a dog suffer and die is troubling, but at least marginally believable.  That every deputy/IHOP employee/customer heard him and was equally cold-hearted?  Zippy chance.


@Forth Amend…....They said they did know about a car.  Maybe the police were smoking the fairy dust because their story changes daily, Stu’s does not.  Have you ever seen LCPD take accountablility in anything?


To Payback and others wondering about the car—- the man was passed out drunk inside the restaurant, which means the car was not part of the crime at hand and cannot be searched without further probable cause.  So, if the cops DID NOT KNOW about a car (Grimes: spaceship, fairy dust, etc), they cannot be responsible for it or its contents.  However, if THEY KNEW about a car, they should have at least made sure it was secure, at which time they’d have seen the dog.  That said, I cannot believe that EVERY SINGLE PERSON (road cops, jailers, magistrte, IHOP, bystanders, people he called from jail) ignored Grimes’ pleas for help with his dog.  It’s just too illogical and far-fetched.  I don’t believe he ever said anything about it.

This truly smells of Police Cover-up and sadly this sounds like it is going to be easily covered up by a couple of Loudoun’s finest. I feel bad that an animal had to lose its life in this matter. I blame both parties and because the sheriff’s office controls animal control they can easily put full blame on this man. I wonder about loudoun county all the time

I totally agree with you they (LCSO, LPD, PPD etc) will find any reason they can to search your car.  I wonder if they didn’t search this mans car because he was arrested out of the IHOP and not his car.  I am beginning to doubt this story either way.  I believe this man said something to someone about the dog and they just ignored his pleas because of their on silly power trip.


So the people blaming the police honestly believe that not one witness to the event (police, IHOP employees, passers-by, or other restaurant patrons) looked for the dog after Mr. Grimes’s pleas.

Does that sound reasonable?  Not one person said let’s find the dog, not one?


Wow!  I am shocked!  This is the first time in the history of any Loudoun County an arrest involving a vehicle that the car was not searched for drugs, other people, children, etc.  It is very disturbing that when this case original opened up in documents to the media and statements made from the police that they did not know there was a car.  Then when they realized a video tape exsisted from the surrounding stores showing lights flashing on the car while they arrested him.  THEN the police changed their story to knowing there was a car, but no dog.  This whole thing stinks of a cover-up.  I think that the State Police and other outside agencies need called in.  This really is scary living in a county where officals cover up and lie.  Stu and Rex depended on these police to serve and protect.  Were the police drunk?  Seems not one person was thinking clearly, sober, or used authrority given to them to serve and protect and Rex died because of them.


Let the justice system handle this sorry case. I hope they reap justice in the correct direction. I believe the judge will see the facts and decide the correct reason why the dog died. Thank goodness for the justice system!

I feel very sorry for the dog.  A moron of an owner killed his dog.  For one he should not have been that wasted alone at an IHOP with his dog locked up in a car in the first place.  how did he get there, Drive? how was he leaving, Driving? he could have killed anyone on the road that morning had he not been arrested.  in short his irresponsibility and excessive drinking killed the dog and the police helped to keep one more drunk driver off the road that morning!


The drunk guy says to the cop, I got here to here by ferry dust. So the cop locked him up for being drunk.
I’m sure the drunk was searched and a wallet was found with an driver’s licenses, I’m sure the cop could see if a car was registered to the drunk..
I don’t understand why the IHOPS parking lot wasn’t searched for the vehicle to be impounded and searched too?
I think since he was drunk the cop took the easy way out!.


I wonder how many people over the last 5 years that the Sheriff’s Dept has arrested and were responsible for ensuring their family pets were taken care of? I do not ever recall special instructions in any law enforcement manual declaring the officer be held accountable for the arrestee’s stupidity.  If a child or animal was obviously present, the officers would have easily placed the (victim) in protective care.  The real truth is, Mr. Grimes was too drunk to even remember the dog was in his vehicle.  He had plenty of opportunities to call someone…even dial 911 from the jail cell letting dispatch know of his dog.  He didn’t.  He is a liar.  If you are such an animal lover, you should be directing anger towards the idiot who killed his own pet. To comment on his behalf, you are delusional.  If you support him, explain why no calls were made to anyone?  He claims he begged?  To who and when? I know I would have made more of an effort to tell someone….at any cost.  He is just trying to lie his way out of additional legal issues.


If there is no evidence one way or the other in this sad situation, how can anyone be charged? Or, perhaps, both parties are at fault. God bless the dog - an innocent - no matter who is to blame.


There is his side their side and the truth…..the blame can shift back and forth, whats important is laws need to be inforced for all for animals and their well being..this dog died a tragic death and the media is again filling up a space on something so sad it makes me wonder what happened to compassion.


I don’t koow about any of you but i have had a time or 2 in my past where I had much to drink but still know if my pet was in the car or anything else that meant anything to me so I’m sure he mentioned it to the police but being in his conditon they probably didn’t take him serious enough or just plain ignored his concern..We’ve all watch enough cops to know this is true…


There are at least 2 sides to every story.  When you act like an idiot and pass out in a restaurant, your credibility goes to zero and with it anyone’s belief of your side.  Had the dog’s owner behaved in something even close to resembling a responsible manner, the dog would be alive and the owner wouldn’t have gone to jail.

Well according to this article it sounds like he’s already be tried, convicted, and hung and sunrise!!!  Those who doubt Stu Grimes love for his dog are ignorant and uninformed. Stu Grimes BEGGED the police to save his dog. What more can a man do when he’s been arrested. Once they took control of Stu Grimes life, it’s up to cops to make sure everything is ok. They failed!


A drunken idiot passes out at a restaurant and we were supposed to believe he did or said something specific.  He probably doesn’t even remember anything before waking up in a cell.  It sounds like the Animal Agency determined none of the dozen officers or magistrate ever heard anything about a dog.  Since all calls from the jail are recorded, it’s safe to assume there was no mention of a dog to anyone, EVER.  Poor Rex - you had a drunk moron for a master.


What a surprise, the county covers its own ass.
