Atari sentenced to two years, nine months in prison

Diane H. Frederick Atari, the Ashburn woman and former realtor accused in a $50 million mortgage and credit scam, will spend more than two years in prison.

Atari pleaded guilty on Oct. 11 to felony counts of making false statements to obtain credit and grand larceny. She was sentenced Feb. 13 to three years on each of her 12 counts, but all was suspended save for two years, nine months. Atari will also be credited for the time she’s already spent behind bars.

“We believe the judge’s sentence was very fair,” defense attorney Steven Webster told the Times-Mirror. “Ms. Atari accepted responsibility for her actions, offered substantial assistance to law enforcement, and has made a commitment to serving others in the future through a transitional program for ex-offenders. She is pleased to put this chapter of her life behind her.”

Atari, who owned and operated ACR Consulting Co. and Atari Management Co., was originally indicted on charges July 13, 2009.

Atari fled to Turkey in 2009 shortly before her indictment, where she was arrested in October of that year.

Since Atari had fled the country by the time of her indictment, local law enforcement had to contact Interpol to help find her. She spent more than a year in prison overseas before her extradition on Feb. 18, 2011.

“The investigation was not an easy one,” said Capt. Ken Pratt of the Loudoun County Sheriff’s Office in February 2011. “It deals with forensic audits and an attention to detail that goes beyond normal fraud and white collar crime investigations.”

Atari fixed her clients’ credit and inflated their incomes to qualify them for homes they couldn’t afford. Atari’s scheme is said to have obtained losses of more than $50 million in mortgages. She is also alleged to have obtained $1 million, personally, from the scheme.

“It’s been distorted and fabricated,” Atari said in court in February 2011. “I’ve offered my cooperation and they’ve denied it. I’ve just tried to seek justice and truth.”

Her rhetoric had appeared to change in the months that followed, as Webster released the following statement on Oct. 11, 2011, after the plea.

“Diane Atari has today acknowledged the mistakes she made years ago. After reflecting on those mistakes and what she has learned from them, during the past several months she has fully cooperated with authorities and has agreed to assist a local Community Services Board in a program aimed at helping offenders readjust to society upon their release to help prevent recidivism,” Webster stated. “I commend the professionalism of [Loudoun County Commonwealth’s Attorney] Mr. [Jim] Plowman and his staff in this matter as well as Investigator Tim Ortwein of the Sheriff’s Office.”

Oh Truthbetold - some of us knew Diane all too well and have for hmm lets say 25 some yrs. She is/has always been about the quick buck and who she can flock to get it.  What did she do with the thousands of dollars she inherited oh yeah up her nose.  She was/is/always will be trying to get the next big con.  Once a con or addict always - Unfortunatley her son is following in her footsteps.  Did I know her oh yeah she actually threatened me before and I stood up to the bitch.  Not one person on here is saying that we feel that murderers, rapist etc should have lighter sentences what we are saying is she did a crime, she stole money from alot of people, she helped in the downfall of real estate, Loudoun Co spent X amount of money on this case and interpol got involved because she ran from the law,  etc which is tax payers money in the end and you think she should not be spending more time in jail.  Maybe just maybe you dont know Diane as well as you think you do.  Take it from someone that knows her when she gets out she will stay clean for awhile to get the shadow off her and back to her old ways. She always does.


I agree. More people should have also been convicted. My best friend brought a house with her help.  How has her daughter in law Natasha Du Toit- frederick managed to not be locked up as well? She was just a dirty as Diane. Through the process of buying the home she managed all the paperwork for Diane. This girl went from making 150 bucks a week to buying a 700,000 house in less than a year? Something is fishy there…. My guess is that she rolled on Diane to keep from going to jail???

Who is saying the free murderers and those that raped are ok?  I believe they should be locked up for life and throw away the key.

No one is saying Diane should get a life sentence but less than three years come on.

I also agree about “the inside job”. It is a shame that more people have not been prosecuted.  The Obama administration has taken a lot of heat for that.

Yes people here know her.  We knew her when she was just Diane Frederick before she married Ali.  That doesn’t mean she should not pay for her crimes.


Actually, I did know Diane. close enough that she was present at my father’s funeral. I remember her when she was sober and when she fell off the wagon.  I remember when she opened the restaurant and the pride she felt when it was full.  But it failed she couldn’t keep it going,  she tried her hand at realty, and packages/shipping, and all that crap.  She got greedy, got cocky and she messed up.  Don’t play like she’s some innocent scapegoat.  She was in it for the quick cash and unfortunately a lot of people trusted that she was helping them. She lied and manipulated people into thinking that it was ok to stretch the truth and change a number here and there, to give false credit by adding people to her own accounts to boost their profiles.  No reputable realtor would do such a thing. Maybe if she’d stayed clean and sober, she would have listened to her conscience, but addicts and alcohols don’t really care much about anyone but themselves.
I am sympathetic to her children who have to live the rest of their lives with this dark shadow over their family.


@Truthbtold - Whether or not a realtor is worth 3% is an entirely different discussions.  Trying to change it AT THE CLOSING TABLE AND THEN THREATENING SOMEBODY IS COMPLETELY WRONG.  Closing time is way too late to try and change commission terms, and threatening somebody is never okay.

As to the rest of your absurd argument, just because other people who should also be held responsible have not been, she should get a free pass?  It’s irrelevant what a good person you thought she was.  If I had a nickle for every time I heard a criminal complain that they just, “got caught with the wrong people.”

(Ashburn realtor you are upset of a commission which you think you really earn as a realtor? Please you are a door opener and if most folks know you don’t need a realtor to help you buy a home just a lawyer and title company so let go of you hate its been 6 years already and really ask yourself if you should get paid 3% commission on the sale of a home for opening the door?)

I knew Diane very well and the side everyone does not read about is how far she went to help others and what most of you don’t know is that she got involve with the wrong people such as a few greedy lenders and the real estate company she worked for that introduced her to a lot shady people that only cared about making the most amount of money possible.
Why did they not get help accountable for anything?

I think it’s terrible that she receives hardly any punishment for everything she put lots of people through.  It must be nice to “negotiate” what about those she scammed.  Don’t care that she’s helping other offenders….did any of her “victims” get monies returned?  I agree with the person that said - she is getting less time than the insurance guy who stole a lot less money.  That makes no sense to me.


I am glad to see this woman go to prison.  She tried to sneakily reduce my commission while at the closing table with my client back in 2006.  When I objected she threatened me and my client.  She is a bad egg.

In your world stealing 7 figures must not be a big deal.  People go to jail for a lot longer than this for burglary and robbery and they steal a lot less.

The judge screwed up with the small sentence and the paper screwed up not reporting who the judge was.


This sets a bad example, she stole 50Million, ruin hundreds if not thousands of families lives. The courts under Plowman and CO are horrific, someone else who didnt have the money for lawyers would of gone to jail for 10 Years+ for lesser crimes.  If it would been one of us, we would of got slammed, I can assure you of that.

I agree with Allen.  It seems like in society all people care about is money. You want someone to spend life in prison for stealing money but then the real criminals’ rapist, and murders get to walk free. What is wrong with this picture? I think she has served her time; being held in a Turkish prison had to be horrible

Wow!  25 comments from people who want to hang her from a yardarm and 1 guy who appears to be selling canadian geese.  Did she kill anyone?  Did she get away with it?  Is her reputation worth anything?  How much time in jail is enough?  Some of you seem to just enjoy destroying people lives.  She made a mistake and paid a pretty severe price for it from my point of view.  She’s probably trying to move on.  Perhaps some of you should as well.  Apparently I am the only one in Loudoun County who thinks the penalty matches the crime.


Wow, to go from 36 years to only having to serve 2 years 9 months….. Someone is sleeping with someone here(the judge, Plowman and Atari) or someone is getting paid off? I wonder how much money the county spent on this case? What about a fine? Bet she hid all the money in Turkey. disgusting!


I agree with most, what a joke. Scam people for millions, leave the country because she knew it was wrong and get very little time in jail? and state no where that she has to repay? I’m another that didn’t vote for this dolt(Plowman), he’s as corrupt as all the other politician and judges in this country. It pays to be a crook.

The lesson learned is that if you want to commit major fraud and leave the country on the run then come to Loudoun.  When you get caught you don’t have to deal with many consequences.

This is a typical Plowman plea deal, especially for those well connected.  The crook gets off easy and Plowman doesn’t have to do any work.  52% of you made the wrong decision in November if you want a real prosecutor in this county.

So you can scam, make a million, evade authorities, and then flee the country and in the end you will get a little slap on the wrist and spend less than three years in jail.

I have to give her lawyer a lot of credit.  This guy got his client off.  The judge on this case should be taken off the bench immediately.  I know that won’t happen.  The judge will probably just let more white collar criminals walk. Shame Shame Shame.

This truly truly sickens me - so she breaks the law, she flees, she obstructs justice and this bitch skates with 2 yrs 9 mo - yes she is smiling all the way to the bank.  WTF is wrong with our judicial system.  They failed big time, she must have gone back to her old ways and screwed someone to get off or better put got someone else off if you get my drift.  What does this say to all the others that do this - go ahead you just get smacked a little it only hurts for awhile!


Loudoun County is the place to do white collar crime. Our judges are meek and mousy as if they just piled in from Disneyland! That other woman from Lovettsville, got a light sentence, maybe they can share a cell and plan for their outcoming scams!


What a shame…. All of the millions of dollars she cost various banks to not suffer for her crimes. She will be up and back in business in no time. Her son Michael recently just got out of prison as well. They will have their criminal enterprises up and running in no time flat. Diane is greedy and it will only be a matter of time before she and her son are back behind bars where they belong.


Crime does pay.  $1,000,000 income and you only have to serve 2.9 years in prison. Let me guess that her destination when she gets out is to her Swiss Bank Account.


“She is also alleged to have obtained $1 million, personally, from the scheme.”  So she only has to give up 2 years and 9 months of her life for $1 million of money to play with?  If being a crook could be viewed as her career, she effectively “earned” a $363,636.36 per year salary.  Isn’t one of the purposes of punishment to deter others from committing similar crimes?  I’m willing to be that millions of people in this country would be willing to get locked up for 2-3 years if they could send that kind of cash home to their families.  She probably had a lot of fun with that money, and I bet the government didn’t recover a penny.


She caused $50,000,000 in losses to banks (Read STOCKHOLDERS). Why didn’t her ‘clients’ get prosecuted too? They KNEW THEY WERE LYING about how much they made and how much they had. That’s bank fraud. I hope all their stuff got broken when they were evicted during forclosure. When you lie to obtain money you are a thief.


You can never trust a rat. Thanks plowman! You gave decent people a black eye because of your ingrained overzealous nature for a job and money. I didn’t vote for you, and the people who did know they made a mistake!


So she gets sentenced to 36 years but will end up doing less than three and with her time served I’m guessing she will be out next year or sooner.

This is truly sad and pathetic.  The judge in this case should be ashamed for a slap on the wrist for someone who defrauded people this much.

In the end white collar criminals always end up getting it easier.  No wonder her lawyer seems so happy and upbeat.


She will be out next week.


It is odd that she is getting less time than the insurance fraud guy.
