Man to serve four years for DWI crash with police car

A 30-year-old illegal immigrant from El Salvador will spend four years in prison for crashing his pickup truck into a police cruiser while under the influence of alcohol.

Jose Joe Velasco, of Herndon, was sentenced in Loudoun County Circuit Court July 23 with DWI, assault on a law enforcement officer and driving on a revoked license, Loudoun County Commonwealth’s Attorney Jim Plowman said. The DWI charge is Velasco’s fourth in 10 years.

The charges stem from Oct. 10, 2009, when deputies were called to Enterprise Street in Sterling at about 2 a.m. for a disorderly man. There, they found Velasco behind the wheel of his pickup truck. When a deputy went over to him and asked him to get out of his truck, Velasco backed out quickly, and tried to leave the scene, Plowman said.

He then ignored commands to stop and sped away, almost hitting the deputy and his cruiser.

At that time, two more deputies responded, and Velasco almost hit the first one and did hit the second. He then tried to flee, and in doing so, ran a stop sign before losing control of his vehicle, Plowman said.

A short time later, police caught Velasco, and he was taken to a hospital and treated for injuries, Plowman said.

Tests confirmed that Velasco had a blood alcohol level of .323, more than four times the legal limit.

Judge James Chamblin sentenced Velasco, and a federal immigration detainer was placed on Velasco since he is in the country illegally. He will likely be deported when his sentence is over, Plowman said.

This guy is a serious drunk four times the legal limit. Most illegals cannot read english traffic signs, so just imagine him being drunk, he had to be dazed and confused.He is very lucky he did kill anybody. They may deport him and he will return and be allowed to drink and drive another 4 times before police take it serious enough to place a
federal immigration detainer on him again. If immigration status has nothing to do with it, then why the federal immigration detainer is that an over sight ?

I entered the country, unfortunately illegally in 2006, but i am pround of it. I have bettered my life, and appreciated the public assistance and education the VA & US Governments provides to me and my 4 children.
I have dreamt of filling the application for to becoming a US citizen, but then i think “why bother? i’ve got it great, the way it is”. I only wish that every mexican could live the dream that I am live here now in the US.  Someday, my wife and other children can come to live too.
(I don’t think some law can stop it.)
But for now, I have a beautiful new girlfriend with blong hair and blue eyes.  i think if she becomes pregnant, then maybe i can stay in loudoun county, even though her mama and father don’t like it.
But for others who make illegal trouble, to drive drunk should go to jail.

Our society gains piece of mind from having this person in jail.  He almost killed two people in this incident… This is not even close to cruel and unusual punishment.  I am sure he got many chances on his first THREE Dui’s to seek help… This was his choice and he made it.  I am sure his attorney advised him of the repercussions of what could happen on a 4th DUI.

wow cruel and unusual punishment. a drunk doesn’t need four years in jail, they need a year or eighteen months in treatment. our society gains nothing by incarcerating this person so long.

Identity theift. Arizona is #1 in the country. Virginia is desperate to get to the top of that list.
For all you folks that play by the rules…think twice when driving down your street or your next purchase at the piggley wiggley. It all comes across the “Cartel Alley”. These folks dont care and will break our laws. Motorcycle insurance in AZ is 4 times what it would be in VA. Why? When a biker gets hit by a illegal, his insurance has to pay. Do you think someone breaking our laws will pay for his own insurance?
Only good thing that happened in this case is that he was involved with the police. Otherwise, he will behave the same way again…and again. Maybe he will kill someone. He shouldn’t be here in the first place. DMV is only one layer….it all starts with Obama. He rather sue the citizens of AZ to protect people like Jose. Arizona is “misguided”....see where that gets you.


Ray, what I meant was WHY is a license issued for an ILLEGAL alien in the first place. If they are illegal, how can they get a license?  My husbands license expired by one day and he had to prove that he was here legally before it would be renewed, even though he was born and raised right here in VA and has held a valid drivers license for over 30 years.  I agree that you don’t need anything but stupidity to drive drunk

Wow - 4 time???...and by all means, let’s sue Arizona for stopping the “illegal aliens” from coming here.  No doubt, no license, no insurance and obviously no conscience.  Four DUI charges and until he hits a police cruiser, he goes free?  I’d hate to think of what I would have done to him had he hit one of my kids or someone I knew and got away with it!


If this guy has four DUI convictions in 10 years, then he falls under the habitual offender statute and could have gotten up to 10 years in prison. If he’s been arrested on three earlier occasions for DUI, then why wasn’t he deported earlier? This is the kind of story a good investigative journalist could dig into and find out specifically, by name, who within the system failed.


I agree with cms…..how did he get a drivers license in the first place if he was here illegally?  There is so much wrong with this system we live in.


He should have to serve the time in his home country.  I am sure prison in El Salvador makes jail here look like a resort.


If we deport him now before his sentence, then he will just walk right back across the border again and be right back in Sterling scamming the taxpayers and will have his fifth DUI within the next month.
