ALEXANDRIA — Delegate Bob Marshall hopes to do for lightbulbs in Virginia what California did for marijuana and Arizona did for guns. But he faces an uphill climb.
The Manassas Republican introduced a bill to allow makers of incandescent lightbulbs to set up shop in Virginia after a federal ban on the bulbs went into effect Jan. 1.
Marshall, a skeptic of global warming, said he has safety concerns about the compact fluorescent bulbs, or CFBs, that are supplanting traditional lightbulbs. The more energy-efficient bulbs carry traces of mercury, and federal guidelines recommend evacuating the site of a broken bulb for up to 10 minutes before trying to clean it.
“The solution is worse than the problem,” he said, “When you drop one of these mercury bulbs you have hazardous materials. It’s a health risk that you wouldn’t have with one of Mr. (Thomas) Edison’s bulbs.”
The same federal guidelines, however, say mercury levels fall below hazardous standards, and increased efficiency has resulted in lower levels of mercury.
Marshall’s proposal would avoid the Interstate Commerce Clause in federal law by limiting distribution to the state. The federal government has used the clause to push regulation on items including guns and drugs. The legislation mirrors efforts in Arizona, where in-state gun magazines have skirted federal firearm regulations, as well as California’s own medical-marijuana industry.
“I have identified other powers reserved to states under the 10th Amendment that we can manufacture these in Virginia without federal interference,” he said. “This is the kind of economic development I get behind. We’re not tossing taxpayer money at companies, we are just allowing them to exist.”
Constitutional scholars are skeptical. Saikrishna Prakash, who teaches constitutional law at the University of Virginia in Charlottesville, said Marshall’s efforts may not hold up in court.
“If the federal government does not want these bulbs built, they can ban interstate and foreign trade and, to make the ban more effective, they can ban intrastate trade to prevent the bulbs from trickling into the market,” he said.
Prakash said the lightbulb policy could go the way of California’s legalization of medical-marijuana production in 1996. In the 2004 case, Gonzales v. Raich, the Supreme Court ruled even if marijuana was grown for personal medical use, legal under state law, the federal government can ban production under interests of interstate commerce.
“Supreme Court doctrine over the years has indicated that Congress can regulate intrastate sales if it relates to interstate sales, so I’m not sure it would hold up,” Prakash said.
Marshall’s proposal says the Virginia Attorney General’s Office would defend bulb makers if the federal government tried to stop production.
“If we tell them they have the protection of the state of Virginia and our attorney general, then they will say that Virginia is the place to do business,” he said.
Caroline Gibson, spokeswoman for Republican Attorney General Ken Cuccinelli, said the office has not yet taken a position on the proposal.
Under a 2007 federal law, the U.S. Congress adopted efficiency standards that did away with traditional 100-watt light bulbs. The law led to increased production of CFBs, and light-emitting diode bulbs, or LEDs, which can be up to 10-times more expensive than traditional bulbs but save energy costs over time.
Former Republican President George W. Bush signed the bill into law, but his contemporary party mates, including Marshall, have taken aim at the regulation.
“This was not a response to consumer demand; it was the federal government interfering in something it had no business doing,” he said.
Should the proposal become law, there’s a decent chance it could survive.
Gonzales v. Raich has not interrupted the medical-marijuana trade in California, which has grown into a $2 billion industry with more than 2,000 dispensaries.
“You have all of these U.S. attorneys and marshals and FBI and they have to determine who they’re going after, and they decided to spend their resources elsewhere,” Prakash said. “That doesn’t mean it’s legal, it just means the federal government does not have the resources to shut down the activity.”
The federal government’s ability to crack down on traditional incandescent light bulbs has even fewer resources after congressional Republicans defunded the enforcement program in December.
But even if the law passes, Virginia is unlikely to attract any new business, since energy companies have invested millions preparing for the bulb ban, said Joe Higbee, spokesman for the National Electrical Manufacturers Association, or NEMA, an industry lobbying group based in Rosslyn.
“The traditional incandescent bulb is not being made anymore,” he said. “People are still able to purchase incandescent bulbs; they are more advanced and efficient because manufacturers are looking ahead.”
Marshall is not worried.
“The market is still there, and I think there are plenty of entrepreneurs in Virginia who will take the industry forward if we provide them protection,” he said.
Environmental groups have pledged to contest Marshall’s proposal.
“We don’t want any type of circumvention of these environmental protections,” said Lisa Guthrie, executive director of the Virginia League of Conservation Voters, or VLCV.
State Sen. Dave Marsden, D-Alexandria, does not expect the bill — or the spirit behind it — to advance far.
“I don’t think it’s going anywhere; they tried this same thing with guns in the past and it hasn’t gone anywhere,” he said. “This whole ‘keep-it-in-Virginia’ mindset makes Virginia look like it has secessionist tones, which is not good for business.”
Marshall said Jan. 4 that he plans to move forward with the proposal when the General Assembly 2012 session begins. The session starts next week.

Did you ever hear the story about how Bill Gates used up all of the propane gas across three counties one winter just to heat his driveway? Some spent thousands on new heating systems and stove systems in order to avoid the situation from happening again. I’m seeing voices from both ideologies being voiced here: Communism Model and Capitalism / Free Market Model. History has told us that both fail. In particular, Free Market fails because there is no such thing as a “Free Market” once humans are involved and there is no such thing as “unlimited resources” whether you are talking unbridled capitalism or unbridled socialism. Further, all people don’t make rational or sound economic decisions with their money 100% of the time. That’s a fact. And most people think they are making informed decisions about purchases but do not because they don’t have all of the information. Think of those people that bought Chinese drywall. They thought that they were making a rational decision right? But they had no idea what toxic stuff was in there. Further, Chris Rock has a joke that all black people are bad with money because all they do is buy rims with it. Imagine a society where 80 to 90 % of the population took all of their money and bought rims with it. Would we be better off as a country? But that would be Free Market right? What if everyone bought so many rims that cars could no longer be produced because there was a shortage of materials? Sounds wacky right? I would imagine we would then have “Mine Baby Mine” candidates and that those trying to pass laws to reduce the amount of metal used in rims were akin to stealing their freedoms. Let’s take this argument one step further. What if a rare earth material was being used to build rims and it’s lack of supply affected the ability of the US Gov’t and military from protecting our nation? Would the gov’t be wrong in stepping in and banning the use of that material in rims such that we can defend this nation and fight and win wars? If a more efficient bulb reduces consumption by 7 to 12%, could this actually help secure our economic futures, supply of future energy sources and help us obtain a more secure energy future? Perhaps increase national security by having more domestic energy available (since we would be using less), reducing price volatility and increasing economic and political stability? Could you argue otherwise? Sure 200 people are losing their jobs in Winchester VA because of this. But haven’t millions lost their jobs due to globalization anyways for other reasons? Could this layoff of 200 people been perfect cover or a perfect political excuse for GE for a decision that was in the works already?
Wish this moron would focus on helping us skirt marijuana laws instead of wasting everyone’s time on lightbulbs. Why is it most of the “you must” stuff comes from the GOP side of the aisle—even as they complain about regulation?
The next great war will be over resources. Either it be Food, Water, or Commodities. That is just a fact of life. We cannot “save” ourselves into prosperity. Bumping up fuel efficiency on vehicles means nothing when you have millions to billions of 3rd world countries moving into the 21st century. 1.3/billion Chinese going from Bikes to Cars will dwarf any fuel savings you squeeze out of 300/million Americans. Throw in another 1/billion people in India and you get the point.
The biggest threat to the world is Affluence. The more people who move from poverty to prosperity, the greater the problem. But supporting foolish ideals of putting a halt to the drilling and exploration of Oil and NatGas in favor of Solar and Wind is a recipe for economic disaster.
Given the recent discovers of 100+/yr supply of NatGas, we should be championing the idea of NatGas Power Plants and NatGas vehicles. Yet the EnviroNazis see all fossil fuels as evil and that is only hurting everybody in the end.
As for taxation, the point I was making was one of fairness. If the Leftist Government currently in power wants to curb the use of inefficient electrically powered devices (ie: incandescent light bulbs), then they shouldn’t single out specific devices in the economy, but tax the primary source of power all those devices need. Then hike taxes so that only purchasing the most efficient devices makes economic sense. Thus spreading the pain of encouraging Green living is felt by all.
Targeting specific devices, industries, etc creates political divisions that lead to the current hostile nation we have now. Its on par with Pre-Civil War society split over Slavery. Except now it is split over issues of energy discovery, distribution, and consumption. This might as well be 1860 with Democrats v. Republicans as proxies for North v. South.

As for you sdrawkcab, when you write a law and set standards above what an incandescent light bulb can do, you are effectively banning it. It would be like saying, any vehicle that cannot run 100% on electricity can no longer be sold in the US. So don’t play stupid, when you darn well know that “Sec. 321. @Steven - 39 states have some version of Dillon’s Rule. That hardly makes Virginia “ridiculous”. Dillon’s Rule was a ruling in the mid-19th century.

Don’t worry, fluorescent bulbs are just a bump in the roadway on the way to LED technology. LED’s have much lower power consumption, longer life, are dimmable and have no mercury. Some are available already (see Home Depot).

Fact is, I bought a case of them when I re-did my basement, and apparently, the don’t work very well on a dimmer circuit; many of them stopped coming on altogether. I replaced those with the old incadescents, and they work fine. Lemme guess, I gotta buy a $50 CF-friendly dimmer switch ? I smell a racket.

The incandescent light bulb worked fine for 100yrs. If it ain’t broke, don’t fix it. At least some smart entrepreneur created (bulbs.com) and it appears they have plenty. And I’m sure some factor in China is now making all the money cranking these bulbs out and shipping them to the US for sale.
This reminds me of the Clinton changes when we all got stuck with 1.5/g flush toilets vs. the 3/gal toilets that actually worked. If I had a nickel for every time I had to plunge a 1.5/g toilet, I’d be wealthy beyond the dreams of avarice.

@Todd Marshall - yes the enforcement money was cut, but no light bulb manufacturer is going back to the old bulbs. They make more money on the new ones, and everyone saves money (except the energy companies) from using less energy.
You won’t be required to buy CFL’s. The new regulation requires efficiency of incadescent bulbs to increase 25%, and will save an estimated $10 billion a year. Hey Bob Marshall, try google first next time. Then you’d know that in December of 2011 Congress overturned (more specifically, made unenforceable) the 2007 law. So you’re wasting time over nothing.
Furthermore a little more reading and you’d realize that the 2007 law was not banning incandescents in the first place, just settings efficiency requirements regardless of bulb type. “Halogena” bulbs are incandescent yet meet the efficiency requirements. Nothing in the 2007 law requires you to use CFLs.
You are buying the wrong bulbs. CFL is come in many different light types. Home Depot has a chart in their bulb section as a guide to what cfl you need for the type of light you want. And yes I have them and the light is identical to a incandescent bulb. And by the way incandescents also come in different light types.
I feel a wax candle may be the answer….. they give off better light than some of this new junk. I find the best way to deal with these new lights is to turn them on first and come back later when they are warmed up so you can see. That saves energy…....NOT
If your CFLs are dying in 3 months, than you’re buying the wrong bulbs. Mine have been fine for 3 years.

This is nothing more than big business making more money on more expensive light bulbs - sure, it’s cheaper in the long run to operate. But only on paper: that assumes electricity rates won’t go up. Fluorescent bulbs have been used in office buildings, garages and homes for decades and we never heard this kind of opposition to their use until now. CF bulbs actually have far less mercury in them than a 3ft, 4ft or 8ft tube yet we still continue to use the latter.
As for the law, it just sets a minimum efficiency on light bulbs. If traditional incandescent bulbs don’t meet the standard, sorry about its luck. There are companies working on more efficient incandescent light bulbs. I wonder how much they will cost.

The real story is the manufacturers have too many designs that is confusing the public what is good for them. We should ban the incandescent and also make the new bulbs easier to understand.
