Rose McGowan seeks to have drug charge in Loudoun tossed out

Lawyers for actress Rose McGowan say a drug possession charge against her in Loudoun should be tossed out of court, in part because she has been a victim of "the Harvey Weinstein machine."

McGowan faces a preliminary hearing next month in Leesburg after authorities say cocaine was found in a wallet she left behind on a United flight at Dulles International Airport in January 2017.

In court papers filed Tuesday, lawyer Jessica Carmichael says five hours passed between the time McGowan got off the plane and her wallet was found by a cleaning crew.

"There is simply no point in time at which the evidence places Ms. McGowan and the cocaine together in the same place," Carmichael wrote.

Carmichael argued the drugs may well have been planted, citing "the underhanded targeting of Ms. McGowan" by Weinstein.

"It is now public knowledge that Weinstein employed underhanded tactics to 'silence' his victims," she wrote, citing reports that Weinstein hired private investigators to trail women who had accused him of mistreatment.

McGowan was one of the first actresses to accuse the now-disgraced producer of sexual abuse.

A spokeswoman for Weinstein did not immediately respond to an email seeking comment Tuesday night.

The motion also seeks dismissal on the technical grounds that drug crimes taking place on an airplane in interstate commerce should be handled in federal court, not state court.


@amerigirl, she was in rehab for heavy drug use. She hung with Marilyn Manson, another known heavy drug user. I’m sure she’ll get off even though she’s guilty.

So a secret Weinstein agent followed McGowen from LAX to Dulles, noticed she left her wallet behind, happened to have some spare cocaine on his person, and without anybody noticing—took possession of the wallet, planted the cocaine, and replaced the wallet, and fled the scene?

Sounds like a bit of a stretch. But the break in the chain of custody is a problem…probably enough for a well-lawyered celebrity to get the case dropped.

Like it or not, all they have to do is provide a shadow of doubt and she walks. And the doubt lies in the time her wallet was not in her sole possession.

more cowbell, how do you know she is a heavy drug user? I’m not saying she isn’t, I just don’t know.  If they know she was separated from her wallet for hours where is their chain of evidence? They might as well hang this one up.

Didn’t she affirm that she was the only one that packed & handled her bag when she checked in?

The lawyer is certainly looking to earn his money but this is a ridiculous attempt.  The drugs were found in January 2017 and she came forward much later that year.  I could see if it was the other way around then maybe he would have a point.

Have to laugh at that defense. A known heavy drug user, claiming someone else placed those drugs.
